PETALING JAYA: A man was sentenced to 20 years in jail and 12 strokes of the rotan by the Tawau sessions court for raping his six-year-old daughter while his wife was at the hospital waiting to give birth.
Buletin TV3 reported that the 43-year-old fisherman pleaded guilty to the charge under Section 376(3) of the Penal Code.
Judge Ahmad Faizadh Yahaya also ordered the man to undergo counselling and be placed under police supervision for three years after his jail term ends. The sentence takes effect from the date of his arrest.
According to the charge sheet, the man raped his daughter at their home in Semporna on Aug 12, 2014.
The court heard that at the time of the incident, the victim was alone with her father as her siblings were at their grandmother’s house and her mother was at Semporna Hospital waiting to deliver her fifth child.
The prosecution was handled by deputy public prosecutor Haikal Hazwan Yatin, while the accused was unrepresented.
