PETALING JAYA: An undischarged bankrupt has pleaded not guilty to a charge of acting as a company director last year.
Noor Hafieza Amran was charged at the Shah Alam sessions court on Sept 29 with acting as a director of Fezz Auto Sdn Bhd on June 2, 2024 despite being an undischarged bankrupt.
She also failed to obtain court approval to hold the position or perform the duties of a company director, the Companies Commission of Malaysia (SSM) said in a statement.
If convicted, she faces a jail term of up to five years, a RM1 million fine, or both, under Section 198(7) of the Companies Act 2016.
Judge Nor Hasniah Razak granted bail of RM5,000 with one surety and imposed additional conditions requiring the accused to report to SSM’s headquarters once a month and surrender her passport to the court until the case is concluded.
The court fixed Nov 6 for mention and for the prosecution to submit the relevant documents.
The prosecution was conducted by SSM prosecuting officer Nurul ‘Ain Shafie while the accused was represented by lawyer Farhanah Shamsuri.
SSM reminded the public that legal action would be taken against any individual found violating or failing to comply with the relevant business laws.
SSM also said it remains consistent in its efforts to enforce compliance with the laws under its purview while ensuring that the corporate community remains aware of its responsibilities and upholds ethical and integrity-based business practices.
